The Ministry of Health understands that high-risk pregnancies are situations in which both the life of the mother and the fetus are at risk and there is a portion of pregnant women who, due to some characteristics, end up having a greater probability of developing conditions. Among them are older pregnant women, overweight and high blood pressure.

When the doctor identifies a situation in which the pregnant woman presents a risky pregnancy, it is common to inform some necessary care, including that she remains at rest, or even performs isolation. When the pregnant woman works outside, it means that she must ask for leave from work. If this happens, the pregnant woman has the right to apply for temporary disability assistance.

This aid was formerly known as sick pay. It is a benefit granted to people who are unable to perform their usual work or activities, whether they are working or not. Therefore, among the situations to have access to the aid are the incapacity for work, the need and the quality of being insured.

According to the situation, the judgment of Theme 220 carried out by the National Uniformization Panel reads as follows:

"1. The role of item II of art. 26 of Law no. 8,213/1991 is exhaustive. 2. The list of diseases mentioned in item II, currently regulated by art. 151 of Law no. 8.213/1991, is not exhaustive, admitting extensive interpretation, as long as the specificity and severity that deserve individualized treatment is demonstrated. 3. A high-risk pregnancy, with a medical recommendation for the worker to be away for more than 15 consecutive days, authorizes the waiver of the grace period for access to disability benefits.” (Theme 220)

Therefore, when the doctor recommends that the pregnant woman be dismissed from the service for more than 15 days, the INSS does not charge a minimum contribution grace period to access the benefit.

Know maternity pay

Do you already know the maternity salary? When the delivery takes place, the beneficiary is entitled to maternity pay. It is a benefit that aims to contribute to the mother after the end of the temporary incapacity aid, since it is not possible to accumulate them.

The maternity salary is offered to INSS taxpayers after removal from work due to the birth of a child, adoption of a child up to 12 years of age or legal guardianship, and after non-criminal abortion. This benefit lasts for 120 days, but in cases of abortion, it is offered for up to 14 days.
