Prove your contributions to request benefits to the INSS

Are you in doubt about the proofs you must carry out to retire or access programs? Then you're in the right place! In this post you will have access to tips and information about the importance of proving your contributions to application for benefits to the INSS (National Institute of Social Security). This should be done right at the beginning of the process.

If you intend to apply for your retirement through the INSS, it is important that you prove all your contributions right away with the application, because if this is not done, you run the risk that the initial date of retroactive payments will be damaged when you get your benefit. Furthermore, prior to the entry into force of Decree 10,410, of June 30, 2020, the date of the administrative application was the starting point for the payment of retroactive payments.

This occurred even if a completely new document was instituted for the process. However, taxpayers currently need to pay the utmost attention, according to the words of lawyer Roberto de Carvalho Santos, a specialist in social security law. He also serves as president of Ieprev (Institute of Social Security Studies). Thus, the lawyer informed that “The tip we give is: present everything from the first moment, when you apply to the INSS. You can add new elements to the Appeals Council, ask for new things, present new documents, but now, with this decree, you can do without the arrears”.

What is a new document in the process of application for benefits to the INSS?

Still according to lawyer Santos, it should be borne in mind that the new element is a situation full of news as well, therefore, the INSS could not put the insured person in this situation of regularization only with its databases. Therefore, the documents that are rectified are not considered new.

For example, the PPP, a document that indicates the Social Security Professional Profile. This is commonly used for the worker to prove his special time for the acquisition of retirement. However, after delivery to the INSS, if the institution finds that a signature is missing, this does not indicate that the necessary delivery of another document will make it new.

However, this differs if the worker does not present the PPP in the administrative route, if it is initially sent on appeal. According to the lawyer, this changes the whole process, since the contribution time increases. Therefore, it is possible that it will be interpreted as a new document.

Also, if the INSS sees that there are pending issues and registration errors, it can send a notification in a letter of demand requesting the regularization of the situation. Thus, the documents that were requested, when delivered, are not considered new.

Retirements requested in 2019 are released by the INSS – application for benefits to the INSS

The INSS releases requested retirements in 2019, as an example we have the case of Clelia Ximenes Igreja, currently 65 years old, filed the retirement request process in early 2019. However, out of 19 years of contribution, only 11 of them were registered to the NIT (Worker Identification Number).

Anderson, Clelia's son, helped her through the whole process. According to him, they gathered the work card, the booklets and a document from the INSS from 1996 that informed the change of the NIT, in which 11 years of contributions were being counted, as the necessary proof document for counting the time of retirement.

When Clelia went to the INSS with the documents in hand, she was told to wait until the institution decided to add them. Following the recommendations, Clélia waited, imagining that they would request these supporting documents before denying her retirement request. However, they denied. However, as Clélia already had everything organized and all the documents in hand, she applied for an appeal after two days.

After this process, she managed to prove the time of service and contribution, except for 6 months before creating her work card. The trial of her case ended up in the second instance of the CRPS (Social Security Appeals Council), and was concluded in November 2021. Clélia managed to retire, however, she did not receive a response from the INSS. Retirement was granted in July 2022, at which time retroactive payment for March 2019 was received.

What documents are needed to prove contribution time?

First, you need to check the Cnis (National Social Information Register). What is not in the register, it is necessary to add the supporting document. Therefore, if you find that some date and period of work are missing, look for documents that prove your time of work.

The verification of any irregularity in your case can be aided by means of the indicators that appear at the end of the registration. Sometimes some information may be missing, such as remuneration, for that, just present your paycheck.
